Terms of Service

By accessing, downloading, or using the Indira Love mobile application ("App"), you agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations.

You represent and warrant that:

• You are at least 18 years of age
• You have legal capacity to enter into this binding agreement
• You are not prohibited from using the App under any applicable law
• You are not a registered sex offender
• You have never been convicted of a felony or violent crime

IF YOU ARE UNDER 18: You are strictly prohibited from using this service. We reserve the right to terminate accounts and report violations to authorities.

Account Creation:

• You must provide accurate, current, and complete information
• You must use your real name and accurate date of birth
• You may only create ONE account
• Creating fake profiles or impersonating others is strictly prohibited

Account Security:

• You are solely responsible for maintaining account confidentiality
• You are responsible for ALL activities under your account
• You must immediately notify us of unauthorized access
• We are NOT liable for losses from unauthorized account use

Account Termination Rights: We reserve the right to suspend, terminate, or refuse service to anyone, at any time, for any reason, without prior notice or liability.

You agree NOT to:

A. Harassment and Abuse

• Harass, threaten, stalk, or intimidate other users
• Send unwanted sexually explicit content
• Engage in hate speech or discrimination
• Bully, insult, or verbally abuse others

B. Fraud and Deception

• Create fake, misleading, or fraudulent profiles
• Use someone else's photos or identity
• Misrepresent your age, marital status, or intentions
• Engage in romance scams or financial fraud
• Request money, financial information, or wire transfers

C. Illegal Activity

• Solicit prostitution or engage in sex trafficking
• Promote illegal drugs or activities
• Share explicit content involving minors
• Violate any local, state, federal, or international laws

D. Technical Violations

• Use bots, scrapers, or automated systems
• Reverse engineer, decompile, or hack the App
• Transmit viruses, malware, or harmful code
• Bypass security measures or verification systems
• Harvest or collect user data without permission

E. Commercial Activity

• Use the App for commercial purposes without authorization
• Advertise products or services
• Promote competing dating services
• Solicit users to join other platforms

F. Content Violations

• Post pornographic or sexually explicit content
• Share violent, graphic, or disturbing content
• Post copyrighted material without permission
• Spam or send repetitive messages

Your Content Ownership: You retain ownership of all content (photos, messages, profile information) you post.

License Grant to Us: By posting content, you grant Indira Love a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable license to:

• Use, reproduce, modify, and display your content within the App
• Create derivative works for App improvement
• Distribute your content to other users
• Use your content for marketing and promotional purposes

Content Responsibility:

• You are SOLELY responsible for all content you post
• You warrant you have rights to all content you upload
• You will not post copyrighted material without permission
• We may remove any content without notice or liability

Our Intellectual Property: All App features, software, design, logos, and trademarks are owned by Indira Love and protected by copyright, trademark, and intellectual property laws. You may NOT copy, modify, distribute, or reverse engineer any part of the App.

Premium Subscriptions:

• Subscriptions are billed on a recurring basis (weekly, monthly, or yearly)
• You authorize us to charge your payment method automatically
• Subscriptions auto-renew unless canceled 24 hours before renewal
• Prices may change with 30 days advance notice
• You can cancel anytime through your account settings

Refund Policy:

• All sales are FINAL unless required by law
• Refunds are provided only as mandated by applicable law
• Account termination for violations does NOT entitle refunds
• Unused subscription time is forfeited upon cancellation

Virtual Items (Coins, Gifts, Boosts):

• Virtual items have NO real-world monetary value
• Virtual items are NOT redeemable for cash or credit
• We may modify, suspend, or discontinue virtual items at any time
• Purchases of virtual items are non-refundable

Payment Processing: Payments are processed by third-party payment processors (Google Play, Apple App Store). Disputes should be directed to the respective platform.

Safety Measures We Provide:

• Photo verification system
• ID verification (optional)
• Scam detection algorithms
• User reporting and blocking tools
• 24/7 moderation team

Your Safety Responsibilities:

• NEVER send money to users - This is almost always a scam
• Meet in public places for first meetings
• Tell friends/family about your plans
• Trust your instincts - if something feels wrong, it probably is
• Report suspicious behavior immediately
• Do not share financial information, passwords, or sensitive data

Background Checks: We do NOT conduct criminal background checks on users. Verification badges indicate photo/ID verification only, NOT criminal history screening.

Your privacy is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• We implement industry-standard security measures
• We comply with GDPR, CCPA, and applicable privacy laws
• You can request data export or deletion at any time

Security Disclaimer: While we implement reasonable security measures, no system is 100% secure. You use the App at your own risk. We are NOT liable for data breaches, unauthorized access, or security incidents beyond our control.

The App integrates with third-party services including:

• Firebase (Google) - Cloud hosting and analytics
• Google AdMob - Advertising
• Payment processors - Subscription billing
• Social media platforms - Optional login

Third-Party Disclaimer: We are NOT responsible for third-party services, their terms, privacy practices, or conduct. Use of third-party services is at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties that defects will be corrected
• Warranties regarding accuracy, reliability, or quality of results
• Warranties that the App is free of viruses or harmful components

Specific Disclaimers:

• We do NOT warrant the identity or intentions of users
• We do NOT guarantee you will find matches or romantic connections
• We do NOT warrant the accuracy of user profiles
• We do NOT guarantee continuous, uninterrupted access

Types of Damages We Are NOT Liable For:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or goodwill
• Service interruption or loss of access
• Unauthorized access to your account
• Errors, mistakes, or inaccuracies in content
• Personal injury, property damage, or wrongful death
• Damages from user interactions, offline meetings, or relationships
• Damages from third-party conduct (including scams, fraud, or crime)
• Damages from viruses, malware, or technical issues
• Damages from decisions made based on App content

Maximum Liability Cap: IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF: (A) $100 USD, OR (B) THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

Jurisdictional Variations: Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Indira Love, its affiliates, officers, directors, employees, agents, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your violation of these Terms
• Your violation of any law or regulation
• Your violation of third-party rights (intellectual property, privacy, publicity)
• Your use or misuse of the App
• Your content or conduct on the App
• Your interactions with other users (online or offline)
• Any fraud, scam, or illegal activity involving your account

This indemnification obligation survives termination of these Terms and your use of the App.

Informal Resolution: Before filing any legal claim, you agree to first contact us at legal@indiralove.app to attempt informal resolution. We will attempt to resolve disputes in good faith for 30 days.

Binding Arbitration: If informal resolution fails, you agree that any dispute shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules.

Class Action Waiver: YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS. You may only resolve disputes on an individual basis.

Jury Trial Waiver: YOU WAIVE YOUR RIGHT TO A JURY TRIAL. All disputes must be resolved through arbitration or bench trial.

Small Claims Exception: You may bring claims in small claims court if they qualify under that court's rules.

Opt-Out Right: You may opt-out of arbitration by emailing optout@indiralove.app within 30 days of account creation.

Our Termination Rights: We may terminate or suspend your account immediately, without prior notice or liability, for any reason including:

• Violation of these Terms
• Fraudulent, illegal, or abusive activity
• Extended inactivity
• Safety concerns
• Any other reason at our sole discretion

Your Termination Rights: You may delete your account at any time through app settings or by visiting our Account Deletion page.

Effects of Termination:

• Your right to access the App ceases immediately
• Your profile becomes invisible to other users
• Your data is deleted according to our Privacy Policy
• Unused subscription time is forfeited (no refunds)
• Virtual items and purchases are forfeited

Survival: Sections regarding intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting unless otherwise stated.

Notification of Changes:

• In-app notification for material changes
• Email to registered users
• Notice on our website
• "Last Updated" date revision

Acceptance of Changes: Continued use of the App after changes constitutes acceptance. If you disagree, you must stop using the App and delete your account.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Exclusive Jurisdiction: Subject to the arbitration agreement, you consent to the exclusive jurisdiction of courts located in Delaware for any legal proceedings.

International Users: If you access the App from outside the United States, you are responsible for compliance with local laws. We make no representation that the App is appropriate or available for use in all locations.

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Indira Love.

Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.

No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment: You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control.

US Government Rights: The App is a "commercial item" with restricted rights for US government users.

Export Control: You agree to comply with all export and import laws when using the App.
